Healthcare Companies Accused of Negligence Leading to Injury

A Texas resident has taken legal action against a group of healthcare-related companies, accusing them of negligence that led to significant personal injury. Leopoldo Peralta filed a complaint on October 4, 2024, in the District Court of Harris County, Texas, targeting Welltower OP LLC, Health Care REIT Inc., and KS Management Services, L.L.C. and LLP.

The lawsuit stems from an incident that occurred on April 6, 2022, when Peralta visited the Kelsey Seybold Clinic at 1010 S. Ponds Dr., Webster, Texas. According to the petition, Peralta was a business invitee at the clinic for medical services when he encountered a hazardous condition in the parking area. The walkway was closed due to construction work, forcing him to navigate around his vehicle where he tripped over an unmarked parking stop. This fall allegedly resulted in severe injuries for which Peralta holds the defendants accountable.

Peralta's claim is built on accusations of negligence by the defendants and their employees. The petition details several alleged failures: maintaining safe premises, warning invitees about dangers, inspecting for hazards, properly training staff on safety protocols, and implementing or enforcing adequate safety policies. These omissions are said to have directly caused Peralta's injuries.

The plaintiff seeks damages exceeding $1 million for various losses attributed to the incident. These include past and future medical expenses, pain and suffering endured both previously and anticipated in the future, mental anguish experienced historically and expected moving forward, physical impairment and disfigurement claims both past and prospective, as well as loss of earnings capacity.

In addition to compensatory damages, Peralta requests pre-judgment interest as part of his recovery package under Texas law. He aims for these damages to be determined by a jury's assessment of what is reasonable given the circumstances presented.
