A slip and fall incident at a popular grocery chain has led to a lawsuit that could have significant implications for customer safety standards. On November 22, 2024, Sushila Kewalramani filed a complaint in the District Court of Harris County, Texas, against H-E-B, LP., alleging negligence and premises liability.
The case centers around an incident that occurred on November 10, 2024, when Kewalramani visited an H-E-B store located at 4950 FM 1463 in Katy, Texas. As an invitee on the premises, she slipped and fell on an unknown substance. The plaintiff claims that H-E-B was aware or should have been aware of the hazardous condition but failed to take appropriate measures to ensure customer safety. "H-E-B knew or reasonably should have known of this dangerous condition on its premises," the petition states, highlighting the alleged negligence of the defendant in maintaining safe conditions for its patrons.
Kewalramani's lawsuit accuses H-E-B of breaching its duty as a premises owner by not making the area safe or warning customers about potential dangers. The legal filing outlines that as a direct result of this breach, Kewalramani sustained significant injuries. The plaintiff is seeking damages under $250,000 for past and future medical expenses, physical pain and suffering, mental anguish, physical disfigurement, lost wages, loss of earning capacity, and both pre-judgment and post-judgment interest.
In her prayer for relief, Kewalramani requests that the court grant her judgment against H-E-B for all incurred damages and injuries. She also seeks compensation for court costs and any other relief deemed appropriate by the court. The plaintiff has demanded a jury trial to address these issues comprehensively.
