Car Wash Negligence: Injured Customer Sues Triple J Mart for Unsafe Conditions

A man has filed a lawsuit against a local business, alleging negligence that resulted in personal injuries. Victor Manuel Reyes Pozos submitted the complaint on October 15, 2024, at the District Court of Harris County, Texas, targeting Triple J Mart and its owners Jin Kyu Lee and Hyon Sook Lee.

The case stems from an incident on February 21, 2023, when Reyes Pozos visited the defendants' car wash located at 9802 Airline Drive in Houston. According to the complaint, as he drove into the car wash bay, his vehicle's front passenger tire fell into an uncovered hole. This unexpected event caused his vehicle to partially fall into the hole, leading to physical injuries and property damage. Reyes Pozos asserts that this accident was directly caused by the negligence of Triple J Mart and its owners.

Reyes Pozos claims that as an invitee on the premises, he was owed a duty of care by the defendants. He argues that they failed to maintain a safe environment or adequately warn him about potential hazards. The lawsuit states: "Defendants knew or should have known in the exercise of ordinary care that a condition of the premises posed an unreasonable risk of harm." Furthermore, it accuses them of failing to inspect or rectify dangerous conditions and not providing sufficient warnings about these risks.

The plaintiff is seeking monetary relief exceeding $250,000 but less than $1 million for various damages including medical expenses, physical pain and suffering, loss of earnings and earning capacity, loss of consortium and household services, disfigurement, mental anguish both past and future, as well as property damage. Additionally, Reyes Pozos is pursuing exemplary damages due to what he describes as "conscious indifference" by the defendants towards his safety.
