Plaintiff alleges negligence against grocery chain H-E-B after injury

A woman has filed a lawsuit against a major grocery chain and one of its employees, alleging negligence that resulted in her injury. On October 25, 2024, Maria de Jesus Flores filed a complaint in the District Court of Harris County, Texas, against H-E-B, LP, H.E.B., Inc., and an employee identified as John Doe.

According to the court documents, Maria de Jesus Flores claims that on October 7, 2023, while shopping at an H-E-B store located on Fry Road in Houston, Texas, she was struck by a tall metal cart pushed by John Doe. Flores alleges that Doe failed to pay attention while maneuvering the cart through the fruit aisle. The impact reportedly caused serious injuries to Flores. The plaintiff argues that John Doe had a duty to exercise ordinary care when pushing the cart but breached this duty by failing to maintain a clear path and proper lookout and not warning her of his approach. This breach is claimed to be the proximate cause of her injuries.

Flores further accuses H-E-B, LP and H.E.B., Inc. of negligence for not adequately training their employee on safety procedures or providing necessary equipment. She contends that these failures contributed significantly to the incident and holds the companies liable under the doctrine of respondeat superior since Doe was acting within his employment scope at the time.

The lawsuit seeks monetary relief exceeding $250,000 but not more than $1 million for damages including physical pain and mental anguish both past and future, loss of earning capacity and wages both past and future, disfigurement, physical impairment, medical expenses incurred due to the incident as well as any other damages allowed by law.

Representing Maria de Jesus Flores are attorneys Sarah Y-Nhi Huynh, Pavel "Paul" Savinov, and Michael Alvarez from Huynh Law PLLC based in Houston. The case has been assigned Case ID 2024-74415 in the 269th Judicial District Court of Harris County with Judge Nelson Cuero presiding.
