Plaintiff alleges restaurant chain's negligence led to severe injury

Michelle Hampton has filed a lawsuit against Brinker Texas, Inc., doing business as Chili's Grill & Bar, alleging negligence after an incident that left her with serious injuries. The complaint was lodged in the District Court of Harris County, Texas, on October 31, 2024. Hampton accuses the restaurant chain of failing to protect its patrons adequately.

The case revolves around an event that took place on July 13, 2024, at a Chili's Grill & Bar location in Pearland, Texas. According to the petition, Hampton was dining with her family when an employee accidentally struck her in the back and head with a highchair. This incident reportedly caused Hampton "excruciating pain and serious injuries." She claims that Brinker Texas has been negligent in training its employees on how to handle highchairs safely and failed to implement necessary safety protocols despite being aware of potential risks.

Hampton’s legal action is based on several allegations of negligence against Brinker Texas. These include negligent hiring practices, inadequate training and supervision of staff, failure to follow industry safety standards, and lack of proper safety equipment. Furthermore, she asserts that the company did not take sufficient measures to prevent such incidents or investigate them thoroughly when they occurred. The lawsuit also cites gross negligence due to the company's alleged conscious indifference towards customer safety.

In terms of relief sought from the court, Hampton is requesting compensation for medical expenses incurred and anticipated future costs related to her injuries. She also seeks damages for physical pain and suffering, mental anguish, loss of earnings and earning capacity, disfigurement, and exemplary damages due to gross negligence. Additionally, she demands pre-judgment and post-judgment interest as well as coverage for court costs.
