Customer Sues Retail Giant Walmart Over Negligence Leading to Injury

In a compelling legal development, a Harris County resident has taken legal action against two major retail corporations, alleging negligence that resulted in personal injury. Leslie Berrospe filed a complaint on November 5, 2024, in the District Court of Harris County, Texas, targeting Wal-Mart Stores Texas, LLC and Wal-Mart Inc. The lawsuit accuses these entities of failing to maintain safe premises, which allegedly led to an accident causing significant harm to the plaintiff.

The case centers around an incident that occurred on May 13, 2023. Leslie Berrospe claims she was shopping at a Walmart store located at 150 W El Dorado Boulevard in Friendswood, Harris County when she slipped on an unidentified liquid on the floor. According to the petition, Walmart owed Berrospe a duty of care as a customer to ensure their premises were reasonably safe or to warn her of any potential hazards. The complaint states that Walmart's failure to do so directly caused her injuries and subsequent damages.

Berrospe's allegations are rooted in premises liability law. She contends that Walmart and its employees neglected several critical responsibilities: maintaining safe conditions for customers, addressing hazardous situations promptly, warning patrons about potential dangers, inspecting the premises adequately for risks, and training staff properly on safety protocols. These failures collectively constitute negligence under Texas law. Furthermore, Berrospe argues that since the employees involved were acting within their employment scope during the incident, Walmart is liable under the doctrine of respondeat superior.

Seeking justice for her ordeal, Berrospe is asking for compensation exceeding $250,000 but not more than $1 million. This sum is intended to cover past and future medical expenses, physical pain and suffering, mental anguish, physical impairment and disfigurement, as well as loss of earnings and earning capacity. Additionally, she requests pre- and post-judgment interest at the highest legal rate allowed by law.
