Beatriz Montenegro has taken legal action against a major grocery chain, alleging negligence and seeking significant damages after a slip-and-fall incident. On November 21, 2024, Beatriz Montenegro filed a complaint in the District Court of Harris County, Texas, against Kroger Texas L.P., claiming that the store's negligence led to her severe injuries.
The lawsuit stems from an incident on October 16, 2023, when Montenegro visited Kroger's store #313 located at 9919 Westheimer Rd, Houston. According to the petition, Montenegro slipped on produce left on the floor without any warning signs or indications of caution nearby. The plaintiff asserts that the premises were poorly maintained and that Kroger failed to warn her of the hazardous condition or make it safe before her visit. As per Montenegro's allegations, "Defendant failed to use ordinary care in ensuring that their premises did not present a danger," which directly resulted in her injuries.
Montenegro accuses Kroger of premises liability and negligent supervision and training. She argues that as an invitee, she was owed "the utmost duty of care" by Kroger under premises liability law. The lawsuit claims that Kroger had actual knowledge of the hazard since it was caused or allowed by its employees. Furthermore, Montenegro contends that Kroger neglected its duty to supervise and train its employees adequately regarding safety protocols and maintenance of the store’s walkways.
The plaintiff is seeking monetary relief exceeding $1 million but not more than $10 million for various damages including past and future medical expenses, physical pain and suffering, lost earning capacity, mental anguish, physical impairment, and disfigurement. Montenegro also demands a jury trial for this case.
