Customer Alleges Negligence Against Grocery Chain Over Slip-and-Fall Incident

A Harris County resident has taken legal action against a major grocery chain, alleging negligence and seeking substantial compensation for injuries sustained in a store incident. Lym Nguyen filed the complaint on November 27, 2024, in the District Court of Harris County, Texas, targeting Kroger Texas, LP and The Kroger Co., doing business as Kroger Store No. K034 East/Houston.

The lawsuit stems from an incident that occurred on July 31, 2023, when Nguyen was shopping at the Kroger store located at 9125 W Sam Houston Pkwy N in Houston. According to the complaint, Nguyen encountered a hazardous condition—a puddle of water—on the floor of the baby aisle. Despite noticing the puddle initially and managing to avoid falling, Nguyen slipped again on the same puddle shortly thereafter, resulting in a fall that caused personal injuries. The plaintiff claims that there were no wet floor signs or warnings about this dangerous condition.

Nguyen's legal representation argues that Kroger failed to exercise reasonable care by not inspecting or maintaining their premises adequately and not warning customers about potential hazards. The lawsuit accuses Kroger of premises liability due to their alleged negligence in maintaining a safe environment for invitees like Nguyen. "Defendants knew or should have known of the dangerous condition," states the complaint, highlighting a breach of duty by failing to inspect and safeguard the premises properly.

In addition to negligence claims, Nguyen's lawsuit also alleges gross negligence on Kroger's part. It asserts that Kroger displayed "a complete disregard for the safety" of its customers by knowingly allowing hazardous conditions to persist without taking remedial actions or providing adequate warnings. The plaintiff seeks monetary relief ranging from $250,000 to $1 million for damages including medical expenses, pain and suffering, mental anguish, and loss of capacity.

The case is being handled by attorneys Benjamin R. Roberts and R. William Hatchett from Benjamin Roberts Law PLLC. They are seeking both compensatory and exemplary damages due to what they describe as gross negligence by Kroger.
