Home Improvement Retailer Accused of Negligence After Customer Injury

In a dramatic turn of events, a Harris County resident has filed a lawsuit against a major home improvement retailer, alleging negligence that resulted in personal injury. George Barbosa lodged the complaint against Lowe’s Home Centers, LLC on December 13, 2024, in the District Court of Harris County, Texas.

The case centers around an incident that occurred on December 15, 2022, when Barbosa visited Lowe's store number 081 located at 19580 Tomball Parkway in Houston. As a business invitee intending to purchase goods from the store, Barbosa claims he was struck by a metal floor sign while waiting in line to exchange an item. This unexpected event allegedly caused him physical injuries and financial losses. The plaintiff argues that Lowe’s Home Centers and its employees were negligent in maintaining safe premises for customers. According to the petition, “Defendant’s breach proximately caused Plaintiff's injuries,” emphasizing that the store failed to adequately warn about or rectify the hazardous condition posed by the metal sign.

Barbosa is seeking monetary relief ranging from $250,000 to $1 million for his injuries and associated damages. His legal team outlines several categories of compensation they believe are warranted due to the alleged negligence of Lowe's Home Centers. These include past and future physical pain and mental anguish as well as past and future physical impairment. Additionally, Barbosa seeks reimbursement for medical expenses incurred as a result of his injuries and anticipates further costs for necessary medical care in the future.

The lawsuit requests judgment against Lowe’s Home Centers within the jurisdictional limits of up to $1 million. It also calls for pre-judgment and post-judgment interest at the maximum rate allowed by law along with all court costs. Furthermore, Barbosa seeks any other relief deemed just by equity or law.
