Plaintiff claims negligence against retail giant Walmart after slip-and-fall incident

Libna Sanchez Silvente has filed a lawsuit against retail giant Walmart, Inc., claiming negligence after a slip-and-fall incident at one of its stores. The complaint was filed on November 26, 2024, in the District Court of Harris County, Texas. The plaintiff alleges that Walmart's failure to maintain safe premises resulted in her sustaining significant injuries.

The incident occurred on April 4, 2023, when Libna Sanchez Silvente was shopping at Walmart store #2 located at 2727 Duvale Road in Houston, Texas. As she was leaving the customer service area, she slipped and fell on a liquid substance on the floor. The plaintiff claims that this fall resulted in bodily injuries due to Walmart's negligence. According to the petition, "the liquid item was located on Defendant’s premise and posed an unreasonable risk of harm to its business patrons such as Plaintiff." The plaintiff asserts that Walmart failed in its duty to keep the premises safe for invitees by not properly covering or cleaning up the spill and failing to warn customers about it.

Sanchez Silvente accuses Walmart of several acts of negligence including creating a dangerous condition through its employees' actions by having an improperly covered liquid, failing to place caution signs or barriers around the spill area, and neglecting to verbally warn customers about the hazard. These failures are said to have directly caused her fall and subsequent injuries. As a result of these alleged negligent acts by Walmart, Sanchez Silvente has suffered physical pain, mental anguish, and physical impairment which may continue into the future.

In her lawsuit, Sanchez Silvente is seeking monetary relief exceeding $250,000 for damages incurred due to her injuries. She requests compensation for past and future medical expenses resulting from her injuries as well as pre-judgment and post-judgment interest as allowed by law. Additionally, she seeks costs of court and any other relief deemed appropriate by the court.
