The lawsuit stems from an incident on February 13, 2024, when Umanzor was shopping at a Walmart store located at 9400 Garth Road in Baytown, Harris County. According to the complaint, while navigating through the register area of the store, Umanzor slipped and fell on a clear liquid substance that had accumulated on the floor. The fall resulted in severe bodily injuries due to what is claimed as Walmart's negligence. The plaintiff asserts that there were no warning signs or other safety measures present to alert customers of the hazardous condition. As an invitee on Walmart’s premises, Umanzor argues that she was owed a duty of care by the defendant to maintain a safe environment.
The petition outlines several points where Walmart allegedly failed in its duty of care: creating or allowing the dangerous condition to exist; failing to warn customers with signs or verbal alerts; neglecting to place barriers around the hazard; and not properly inspecting or maintaining their premises.
