A dramatic collision has led to a lawsuit in Harris County, Texas, as a resident claims negligence by a utility construction company resulted in severe injuries. Vilma Gonzalez filed the complaint against Digco Utility Construction, LP on December 27, 2024, at the District Court of Harris County. The case revolves around an incident that occurred on October 28, 2024, when Gonzalez was struck by a vehicle owned and operated by Digco while she was stopped at a stop sign.
According to the petition filed by Gonzalez, the accident took place near Berry Road and Hardy Road when Digco's vehicle abruptly reversed from a private facility without proper caution. This sudden maneuver resulted in the vehicle colliding with Gonzalez's car. The plaintiff alleges that the driver failed to maintain a proper lookout and yield right of way, operating the vehicle unsafely which led to her sustaining injuries to her neck, back, spine, arm, and other parts of her body. "Defendant failed to keep a proper lookout," states the complaint, highlighting the lack of care exercised by Digco's employee during the incident.
Gonzalez accuses Digco Utility Construction of multiple counts of negligence including failure to maintain safe speed and distance, inadequate supervision and training of employees, and violation of state and federal safety regulations. The complaint asserts that these failures collectively amount to gross negligence on part of Digco. Furthermore, it is alleged that Digco breached duties imposed by Texas transportation statutes which are designed to prevent such accidents.
The plaintiff seeks compensatory damages exceeding $1 million for physical pain and suffering both past and future, mental anguish, disfigurement, loss of earning capacity among others. Additionally, Gonzalez is pursuing exemplary damages due to what she describes as reckless disregard for safety exhibited by Digco’s driver. The suit also invokes the doctrine of respondeat superior claiming that since the driver was acting within his employment scope during the accident; Digco is liable for his actions.
