Tenant Alleges Negligence Against Property Management Over Hazardous Staircase

A tenant is taking legal action against her landlord after suffering injuries due to a hazardous condition in her apartment complex. On December 31, 2024, Bonnie Barnes filed a complaint in the District Court of Harris County, Texas, against 2501 Westridge, LLC. The lawsuit alleges negligence on the part of the property owners for failing to address known safety issues.

According to the court documents, Barnes was residing at Villa Solano Apartments, formerly known as West Ridge Garden Apartments, located at 2501 Westridge Street in Houston. On July 18, 2024, she tripped over a defective end cap on the stairs within her townhouse and fell, resulting in severe injuries including neck and back pain and a broken tooth. Despite notifying the management multiple times about the faulty staircase since moving into Apartment 39, no repairs were made. Barnes claims that as an invitee of the premises, she had no choice but to use the staircase and accuses the defendant of negligence for not rectifying or warning about this dangerous condition.

The plaintiff's petition outlines several specific accusations against 2501 Westridge, LLC. These include failure to maintain safe conditions on walkways and floors, inadequate inspection and correction of hazardous areas, negligent hiring and supervision of employees and subcontractors, and lack of communication regarding potential dangers on-site. Each alleged act or omission is claimed to have directly contributed to Barnes' injuries.

Barnes seeks monetary relief amounting to $250,000 or less for damages incurred from medical expenses—both past and future—pain and suffering, physical impairment and disfigurement, as well as lost wages. She requests that judgment be passed against the defendant for these damages along with pre-judgment and post-judgment interest costs.
