Customer Alleges Negligence Against Retail Giant After Slip-and-Fall Incident

A routine trip to a local supercenter turned into a legal battle as a customer claims negligence after suffering injuries on the premises. Jeanette Samuels filed a complaint against Walmart Stores, Inc., Store #2066 in the District Court of Harris County, Texas, on March 21, 2025. The lawsuit accuses Walmart of failing to maintain safe conditions at their Houston location, leading to her fall and subsequent injuries.

According to the court documents, on July 24, 2023, Jeanette Samuels visited the Walmart Supercenter at 2727 Dunvale Road in Houston for her weekly grocery shopping. While navigating near the deli section, she slipped on liquid that had leaked from a refrigerated display. The plaintiff alleges that there were no wet floor signs or warnings present to alert customers of the hazard. "The wet floor made the floor an unreasonably dangerous condition," states the petition. Samuels suffered significant pain and required extensive medical treatment following the incident.

Samuels contends that Walmart's negligence and gross negligence were directly responsible for her injuries. She argues that Walmart failed to exercise reasonable care by not placing warning signs or taking immediate action to address the spill. The complaint further alleges that Walmart had actual or constructive knowledge of the hazardous condition but did nothing to mitigate it. Citing these failures, Samuels seeks monetary relief under $250,000 for damages within the court's jurisdictional limits.

The lawsuit outlines several causes of action against Walmart: negligence, gross negligence under common law and statute, respondeat superior (holding employers liable for employees' actions), and premise liability. Samuels claims that Walmart's employees were negligent in maintaining safe conditions and failed in their duty to warn customers about potential hazards. The plaintiff is seeking various forms of damages including actual damages (both economic and non-economic), nominal damages, exemplary damages for gross negligence, and punitive damages due to alleged malice or conscious disregard for safety.
