Houston Resident Sues Apartment Complex Over Negligence Leading to Injury

Alma Garcia has taken legal action against a prominent apartment complex in Houston, alleging negligence that led to her severe injuries. On January 10, 2025, Alma Garcia filed a complaint in the Civil District Court of Harris County, Texas, against Pine Creek Apts, LLC, doing business as Pine Creek Apartments. The lawsuit stems from an incident on May 16, 2023, when Garcia claims she was injured due to a hazardous condition at the apartment complex.

According to the complaint filed by Garcia's attorneys Joseph Malouf and Adam Ramji of Ramji Law Group P.C., the plaintiff was descending a staircase at Pine Creek Apartments when she fell due to a broken stair step. This defect allegedly posed an unreasonable risk of harm, which the defendant knew or should have known about through tenant complaints. Despite this knowledge, Pine Creek Apts is accused of failing to remedy the situation or provide adequate warnings. "The staircase was the only means of ingress and egress to and from Plaintiff's apartment," states the petition, highlighting the critical nature of maintaining such facilities safely.

Garcia accuses Pine Creek Apts of several counts of negligence including failure to maintain safe premises and negligent hiring and training practices. The lawsuit asserts that these failures were proximate causes of her injuries which required substantial medical care. The complaint further alleges gross negligence on part of Pine Creek Apts for acting with reckless disregard for safety by not addressing known hazards. "Defendant’s acts and omissions were committed with complete and reckless disregard for...the rights, safety, and welfare of Plaintiff," reads a section from the petition.

The plaintiff seeks unliquidated damages within the jurisdictional limits of the court but specifies an amount over $250,000 but not exceeding $1 million as per Rule 47 notice requirements. She is asking for compensation covering past and future physical pain, mental anguish, medical expenses, lost wages among other damages including exemplary damages aimed at punishing gross negligence.
