Emmanuel Quiroz has filed a lawsuit against Elite HS Staffing, LLC and Elite Health Services in Harris County, Texas, alleging negligence after a workplace accident. The complaint was officially lodged on January 10, 2025, by Quiroz in the District Court of Harris County, accusing the defendants of failing to maintain safe working conditions.
According to the petition, Quiroz was employed by Elite HS Staffing and/or Elite Health Services when he suffered injuries from slipping on a wet floor at the premises located at 4001 W. Sam Houston Parkway #110, Houston, Texas. The incident occurred on February 20, 2023. Quiroz claims that the wet floor resulted from a leaky roof—a hazard known to the defendants prior to his injury. He asserts that this oversight constituted negligence on part of the defendants who failed to warn him or rectify the unsafe condition.
The plaintiff highlights that both companies were non-subscribers to the Texas Workers' Compensation System at all relevant times. This status prohibits them from claiming contributory negligence or assumption of risk by Quiroz under Section 405.033 of the Texas Labor Code. The complaint outlines several points of alleged negligence including failure to provide a safe workplace, inadequate inspection and maintenance of premises, neglecting necessary repairs to prevent leaks, and not warning about or mitigating the wet floor hazard.
Quiroz is seeking compensation for physical and mental pain and anguish, loss of wage-earning capacity, physical impairment, disfigurement, and medical expenses resulting from his injuries. He is demanding monetary relief ranging between $250,000 and $1 million as determined by a jury trial he has requested under Rule 216 of the Texas Rules of Civil Procedure.

Nielsen from The Nielsen Law Firm P.C., Quiroz is calling for judgment against Elite HS Staffing and Elite Health Services with damages exceeding jurisdictional limits alongside pre-judgment interest, post-judgment interest, court costs, and any other entitled reliefs.
