The case stems from an incident on September 9, 2024, when Henry Williams was visiting his aunt at Westwood II Apartments in Houston. During his visit, a verbal altercation between two unknown individuals escalated into gunfire, resulting in Williams being shot in the leg. He was subsequently hospitalized until September 11, 2024. Williams claims that Make Time LLC failed to implement adequate security measures despite being aware of high crime rates at the property. The plaintiff argues that the defendant neglected its duty to protect tenants and guests from foreseeable criminal acts.
Williams' petition outlines several accusations against Make Time LLC. He asserts that the company knew about frequent violent crimes at the apartment complex but did not take reasonable steps to prevent them. According to the complaint, "Defendant knew there was a lack of adequate security on the premises," which posed a significant safety hazard. The lawsuit further alleges that Make Time LLC breached its duty by failing to maintain safe conditions and tolerating criminal activities within the complex.
The plaintiff is seeking over $1 million in damages for past and future pain and suffering, mental anguish, physical impairment, disfigurement, medical expenses, lost wages, and loss of earning capacity. Additionally, Williams is pursuing exemplary damages due to what he describes as gross negligence by Make Time LLC. He contends that the company's actions demonstrated "an extreme degree of risk" and conscious indifference towards tenant safety.
