Ishmael Littleton and his family have filed a lawsuit against a Texas-based grocery chain, alleging severe injuries from a dangerous incident at one of its stores. The complaint was filed by Ishmael Littleton, individually and as next friend for Jaleecia Littleton, Jamal Littleton, Jamiyah Littleton, Jailee Littleton, and Trekia Harden in the District Court of Harris County on January 31, 2025. The defendant named in the suit is Fiesta Mart, L.L.C.
The case stems from an incident that occurred on May 16, 2024, when the plaintiffs were visiting the Fiesta Mart located at 5815 Lockwood Drive in Houston. According to the complaint, while the plaintiffs were in their vehicle outside the store, a large air conditioning unit detached from the building and fell onto their vehicle. This unexpected event resulted in significant injuries to the plaintiffs. The lawsuit claims that Fiesta Mart was negligent in maintaining safe premises and failed to warn customers about potential hazards. "Defendant had a duty to use ordinary care to ensure that the Store... did not present a danger," states the petition.
The plaintiffs argue that Fiesta Mart's negligence extended beyond mere oversight of physical conditions; it included failures in training and supervising employees adequately. They allege that employees were not properly trained to identify or rectify hazardous conditions like those posed by the faulty A/C unit. Furthermore, they claim that Fiesta Mart did not have adequate safety protocols or procedures to prevent such incidents from occurring.
In seeking justice through this lawsuit, Ishmael Littleton and his family are requesting monetary relief amounting to $74,000. This sum is intended to cover medical expenses incurred due to injuries sustained during the incident as well as compensation for pain and suffering endured since then. Additionally, they seek damages for lost wages and diminished earning capacity resulting from their inability to work post-incident.
