In a gripping legal battle unfolding in Harris County, Texas, Jasmine Simmons has filed a lawsuit against Xanitos, Inc., alleging negligence after suffering life-altering injuries at her workplace. The complaint was officially lodged on February 11, 2025, by Simmons in the District Court of Harris County. She accuses Xanitos, Inc., a corporation operating in Texas, of failing to maintain safe conditions at her place of employment.
The incident occurred on March 22nd when Simmons, working as a nurse at Memorial Hermann – Texas Medical Center, slipped on a wet hospital floor while attempting to assist a patient. Due to a language barrier with the patient whose native language was Spanish, Simmons left the room to find a translator. As she exited into the hallway, she slipped on an unmarked wet surface and fell violently. According to the petition, there were no warning signs present at the time of her fall. An employee of Xanitos allegedly witnessed the fall and only then placed a caution sign beside her as she lay injured.
Simmons claims that this negligence resulted in severe structural injuries requiring extensive medical attention and has significantly impacted her ability to work and care for her three minor children. The lawsuit argues that Xanitos failed to uphold its duty to ensure safe premises by not providing adequate warnings or maintaining the hospital floor safely. "Defendant's acts and/or omissions solely, directly, and proximately caused Plaintiffs to sustain...physical pain and suffering," reads part of the complaint.
Simmons is seeking damages ranging from $200,000 to $1 million for medical expenses, lost wages, pain and suffering, mental anguish, loss of consortium with her children due to her injuries, and potential punitive damages should further egregious conduct be uncovered during discovery. Additionally, she demands compensation for attorney fees and court costs.
