A Houston resident has taken legal action against a major home improvement retailer, alleging negligence that led to severe injuries. On February 11, 2025, Anthony McGill filed a complaint in the District Court of Harris County, Texas, accusing The Home Depot of failing to maintain safe premises at one of its stores.
According to the lawsuit, on June 1, 2024, McGill was visiting The Home Depot located at Hillcroft St., Houston when he slipped and fell due to accumulated rainwater near the store's entrance. The plaintiff claims that the water made the floor unreasonably slippery and that there were no warning signs or safety measures in place to prevent such an accident. McGill asserts that as an invitee on the premises, he was owed a duty of care by The Home Depot to ensure his safety. "The hazardous condition was open and obvious," states the petition, emphasizing that McGill received no warnings about the potential danger before his fall.
The complaint outlines several allegations against The Home Depot including failure to maintain safe pathways and entryways, neglecting to warn customers of dangerous conditions, and inadequate employee training regarding floor maintenance. Furthermore, it is alleged that The Home Depot had continuous and systematic contacts with Texas sufficient for establishing jurisdiction over them. Venue is claimed proper in Dallas County as significant events leading up to this lawsuit occurred there.
McGill is seeking monetary relief ranging from $1 million to $10 million for damages incurred as a result of his injuries. These damages include past and future medical expenses, physical pain and suffering, loss of earnings and earning capacity, disfigurement, mental anguish, and loss of household services both past and future. Additionally, McGill demands a jury trial for this case.
Represented by attorney Terry McGovern from McGovern Law Firm based in Houston, Anthony McGill hopes for a judgment against The Home Depot for an amount within the court's jurisdictional limits along with pre-judgment interest from the date of injury through judgment at maximum allowable rates under law.
