In a gripping legal confrontation, a Texas resident has filed a lawsuit against a local company for alleged negligence that resulted in severe personal injuries. On February 13, 2025, Haresly Gonzalez lodged a complaint in the District Court of Harris County, Texas, targeting APTWT, LLC. The case stems from an incident on December 29, 2023, when Gonzalez suffered injuries after stepping into an uncovered sewage hole in the poorly lit parking lot of Oak Park Station.

According to the petition filed by Gonzalez, APTWT, LLC failed to uphold its duty to provide safe premises and neglected to warn residents and visitors about potential hazards. The lawsuit highlights that the defendant's failure to maintain adequate lighting and secure dangerous areas directly led to Gonzalez's injuries. "Defendant breached this duty by not only allowing residents within the Premises but also by failing to warn its tenants of the unreasonably dangerous condition," reads the complaint. Gonzalez accuses APTWT, LLC of creating hazardous conditions and failing to take necessary precautions such as warning signs or barriers.

The plaintiff's claims extend beyond mere negligence; they also include allegations of negligent training and supervision of employees responsible for maintaining safety standards at the premises. Furthermore, Gonzalez argues that APTWT, LLC is liable under premises liability theory for not inspecting or remedying known dangers. Asserting that these oversights were a proximate cause of her injuries, Gonzalez seeks monetary relief exceeding $1 million for damages including medical expenses, pain and suffering, mental anguish, and loss of earning capacity.

Gonzalez's legal team is requesting that all relevant evidence be preserved by APTWT, LLC to prevent spoliation. The plaintiff demands compensation within the court's jurisdictional limits along with exemplary damages as per Texas Civil Practice and Remedies Code Chapter 41. Represented by attorneys Russell Morris, Nefi K. Lopez, and Pablo Franco from Lopez Franco PLLC based in Houston, Gonzalez aims for justice against what she perceives as gross negligence on part of APTWT, LLC.

The case is presided over by Judge Rhonda Momon under Case ID 2025-10060 in Harris County’s 190th Judicial District Court.
