Gerald Gonzales has filed a lawsuit seeking over $1 million in damages following a slip-and-fall incident at a swim school. The complaint was lodged on February 14, 2025, by Gonzales in the District Court of Harris County, Texas, against Aqua-Tots Swim School Spring/Klein and MCLS Enterprises, LLC.
According to the petition, the incident occurred on September 28, 2024, when Gonzales visited the premises located at 6935 Cypresswood Drive, Suite A, Spring, Texas. Gonzales claims he was an invitee at the facility when he slipped and fell due to water on the ground. The lawsuit asserts that both Aqua-Tots and MCLS were responsible for maintaining safe conditions as they were owners or operators of the premises. "Defendants had actual knowledge of the spilled water but failed to adequately clean it or warn invitees of the danger," alleges Gonzales. He further contends that as an invitee, he had no duty to inspect for latent defects and that Defendants' negligence in maintaining a safe environment led directly to his injuries.
The complaint details several accusations against Aqua-Tots and MCLS under premises liability and negligence theories. These include failing to maintain safe conditions on floors and walkways, neglecting to inspect or correct hazardous conditions, and not informing visitors about potential dangers. Gonzales emphasizes that these failures constituted negligence and were proximate causes of his injuries. The plaintiff sustained significant injuries from the fall, including traumatic brain injury and spinal damage. Consequently, he seeks compensation for past and future medical expenses, pain and suffering, physical impairment and disfigurement, lost wages, and diminished earning capacity.
