Plaintiff Terrance Tate alleges Maverick Distributing Company's Negligence in Vehicular Accident

Terrance Tate has filed a lawsuit against Maverick Distributing Company, LLC, accusing the company of negligence after a vehicular accident that left him with serious injuries. The complaint was filed in the District Court of Harris County, Texas on March 13, 2025. The plaintiff claims that an employee of Maverick Distributing Company, while acting within the scope of his employment, caused the accident and subsequently fled the scene without providing contact information.

The incident occurred on December 17, 2024, at a service station located at 5100 Yellowstone Street in Houston. According to the petition, Terrance Tate was attempting to exit the service station when his vehicle was struck by a commercial vehicle operated by an employee of Maverick Distributing Company. The employee's failure to maintain proper lookout and control over the vehicle is cited as negligence. Furthermore, it is alleged that this negligence is compounded by violations of Texas Transportation Code §545.401 which pertains to reckless driving.

In addition to negligence claims against the driver, Tate accuses Maverick Distributing Company of negligent hiring, supervision, and entrustment. He argues that the company failed in its duty to properly select and train its employees and negligently entrusted a vehicle to someone who ultimately caused harm. Under the doctrine of respondeat superior, Tate holds Maverick accountable for their employee’s actions during his employment.

Tate seeks monetary relief exceeding $1 million for damages including past and future medical expenses, physical pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. He also requests pre-judgment interest, post-judgment interest, court costs, and any other relief deemed appropriate by the court.
