Plaintiff alleges negligence against grocery giant following slip-and-fall incident

In a dramatic turn of events, a Harris County resident has taken legal action against a major grocery chain, highlighting concerns over customer safety and corporate responsibility. Carolina Gloria Hernandez filed a complaint on March 28, 2025, in the District Court of Harris County against Kroger Texas L.P. and The Kroger Co., following an incident that she claims resulted in significant personal injury.

The case revolves around an alleged slip-and-fall accident that occurred on May 7, 2024, at the Kroger store located at 9919 Westheimer Road in Houston, Texas. Hernandez asserts that while shopping at the Elmside Kroger location, she slipped on a substance present on aisle seven due to the store's failure to maintain safe conditions. According to the plaintiff's petition, "the floor was not slip-resistant," and there were no warning signs to alert customers of potential hazards. Hernandez accuses Kroger of negligence for not ensuring the premises were safe for its patrons.

Hernandez's legal team argues that Kroger is liable under premises liability and negligence theories. They claim that the defendants negligently allowed dangerous conditions to exist by failing to keep the store floor free from slippery substances or debris and neglecting to inspect or correct these hazardous conditions adequately. Furthermore, they allege that Kroger failed to provide adequate warnings about these dangers despite being aware or should have been aware of them through ordinary care.

The plaintiff seeks monetary relief ranging from $250,000 to $1 million for damages including past and future medical expenses, pain and suffering, mental anguish, physical impairment and disfigurement, lost wages, and loss of earning capacity. Additionally, Hernandez demands pre-judgment and post-judgment interest as well as court costs.
