Pamela Byrd Alleges Negligence Against Walmart Following Injurious Shelf Collapse Incident

Pamela Byrd, a Texas resident, has filed a lawsuit against Walmart Stores Texas, LLC, doing business as Walmart Supercenter #1062, following an incident that occurred on June 23, 2024. The complaint was filed in the District Court of Harris County, Texas on April 4, 2025. Byrd alleges that while she was shopping at the Walmart located at 150 El Dorado Boulevard in Friendswood, Texas, a shelf unexpectedly collapsed onto her, causing significant personal injuries.

According to the lawsuit, Byrd was an invitee on the premises when the accident happened. She claims that Walmart failed to maintain safe conditions within their store and did not provide adequate warnings about potential hazards. The plaintiff argues that at least one employee or agent of Walmart was aware of the dangerous condition posed by the unstable shelf but did nothing to rectify it or warn customers like herself. As a result of this negligence, Byrd sustained injuries when the shelf fell on her.

The legal action is grounded in premises liability law. Byrd contends that Walmart had a duty to ensure their premises were safe for customers and that they breached this duty by allowing an unsafe condition to exist without proper warning or corrective measures. The complaint highlights several failures on Walmart's part: "Defendant failed to maintain the area in question in a safe manner," and "Defendant’s lack of care proximately caused Plaintiff's injuries."

Byrd is seeking monetary relief for damages incurred due to her injuries. She outlines various forms of compensation she believes are warranted: past and future medical expenses, pain and suffering both past and future, mental anguish experienced now and anticipated in the future, as well as lost wages and income. While she specifies that she seeks less than $250,000 in total damages from Walmart, she reserves the right to adjust this amount based on evidence presented during trial.

Additionally, Byrd requests reimbursement for court costs under Rule 131 of the Texas Rules of Civil Procedure and seeks pre-judgment interest starting from thirty days after payment becomes due until judgment is rendered. Post-judgment interest is also sought until full payment is made.
