Kamyar Biazar has filed a lawsuit against Aguilar Roofing, LLC, alleging negligence and breach of contract following a botched roofing job that led to significant property damage. The complaint was filed on April 25, 2025, in the District Court of Harris County, Texas. Aguilar Roofing, LLC is accused of failing to properly install a roof which resulted in leaks and subsequent damages.
According to the plaintiff, Kamyar Biazar contracted Aguilar Roofing, LLC on October 21, 2023, for the installation of a TPO roof at his property located at Hunters Creek Drive in Houston. However, just days after its completion on August 29, 2023, the roof began leaking. Biazar claims this negligence caused substantial property damage and loss of use and income. "The Defendant failed to use ordinary care by various acts of omissions," states the petition.
Biazar's legal team outlines several allegations against Aguilar Roofing. They assert that the company did not monitor or maintain the roof adequately and failed to train their employees properly. Additionally, they accuse Aguilar Roofing of gross negligence under Texas Civil Practice & Remedies Code §41.001(11), stating that the company was aware of the risks but proceeded with disregard for safety standards.
The plaintiff seeks monetary relief ranging from $200,000 to over $1 million for damages including penalties, costs, expenses, pre-judgment interest, and attorney fees. Biazar also requests a jury trial to address these grievances formally.
