In a gripping legal battle, a Texas resident has filed a lawsuit following a vicious dog attack that left him injured. The plaintiff, Braddek Wright Shaw, initiated the complaint in the District Court of Harris County on April 28, 2025, targeting defendants Ingrid Jannette Guerrero, Martha Luz Aviles, and Mario Alfredo Aviles. The case revolves around allegations of negligence and liability after Shaw was attacked by a dog owned by the defendants while he was soliciting pest control services at their residence.
According to the court documents, Shaw claims that on or about April 5, 2025, he was attacked by the defendants' dog while on their property. He alleges that the dog had dangerous propensities known to the defendants and that they failed to take necessary precautions to prevent such an incident. "Defendants knew or should have known of the vicious animal's propensities," states Shaw in his petition. The lawsuit outlines multiple causes of action including strict liability for owning a dangerous animal, premises liability for failing to secure the premises against such risks, and negligence for not restraining or warning about the animal.
Shaw is seeking monetary relief exceeding $1 million for damages incurred due to the attack. His claims include compensatory damages for medical expenses, lost income, pain and suffering, mental anguish, disfigurement, physical impairment, loss of consortium and household services among others. Additionally, he seeks exemplary damages as well as pre- and post-judgment interest and court costs.
