Arm wrestling incident at gentleman's club leads to $1M lawsuit

An arm wrestling contest at a gentleman's club has resulted in a lawsuit seeking more than $1 million in damages.

Shawn Gregg of Galveston County filed a lawsuit March 10 against Carl Arceneaux and A and D Interests in Galveston County District Court, claiming negligence and willful harm in a November 2014 incident at the defendants’ place of work.

Gregg was a customer at Heartbreaker’s Gentlemen’s Club, owned and operated by A and D Interests, on Nov. 21, 2014. He engaged in an arm-wrestling contest with Arceneaux. After winning a first round, the plaintiff was asked for a rematch.

According to papers filed, the defendant stood up, shifted his body weight, and broke Gregg’s arm.

The plaintiff claims that Arceneaux intentionally harmed him; that he did not consent to the maneuver; and that the establishment is equally responsible for his injury because Arceneaux was acting within the scope of his employment as a bartender whose responsibilities include entertaining patrons, according to the suit.

Gregg alleges that the defendant Arceneaux was negligent and that the club itself, defendant A and D Interests, was remiss in failing to provide adequate security, warn him of any impending attack, or exercise reasonable care in operating the premises.

Citing pain and suffering; anguish; physical impairment and disfigurement; lost wages and earning capacity; and medical expenses, the plaintiff seeks: more than $1 million in compensation, plus attorney’s fees, expenses and costs.
