While dining at the Texas Roadhouse in Port Arthur, Mitzi Stevens slipped and slid down the restaurant's wooden ramp, injuring her right knee.
Stevens claims she had to undergo surgery the following day and has filed suit against Texas Roadhouse seeking monetary compensation.
Her suit was filed on May 15 in the Jefferson County District Court.
According to Stevens' petition, she paid a visit to the restaurant on Memorial Boulevard on July 26, 2006. As she was walking on the descending wooden ramp in the dining area, she slipped and fell, "causing her to sustain injuries to her right knee."
"Plaintiff also underwent knee surgery the next day wherein two screws were inserted into her knee cap, leaving a 7-inch scar," the suit says.
"Defendant was negligent in maintaining the conditions of the premises and had actual and constructive notice of the dangerous condition."
The suit does not say if the ramp was wet or slick in any way, only that the ramp "created (an) unreasonable risk of harm."
Stevens is suing for past and future mental anguish, lost earnings, impairment and medical expenses.
She is demanding a trial by jury and is represented by attorney Travis McCall of the McCall & Devenzio law firm.
The case has been assigned to Judge Gary Sanderson, 60th Judicial District.
