SHERMAN - A young Collin County woman has filed a gender discrimination lawsuit against Kentucky Fried Chicken that argues the company filed to take action against a co-worker who was committing sexual harassment.
Blanca Rodriguez filed suit against Cerp Foods Inc., doing business as Kentucky Fried Chicken, on Aug. 1 in the Eastern District of Texas, Sherman Division.
At the time Rodriguez was employed with the defendant, from June 2009 through Sept. 18, 2009, she was only 17 years old. She states that during her employment, she was subjected to verbal and sexual harassment by a co-worker. Rodriguez states that she and her father spoke with the restaurant manager regarding the co-worker's behavior but that he did not take appropriate action.
When the minor attempted to return to work, she saw the co-worker's vehicle at the restaurant, and "was forced to terminate her employment."
The defendant is accused of failing to have an anti-harassment policy in place, violating Rodriguez's civil rights and for failing to take stop the sexual harassment in violation of the plaintiff's civil rights.
The plaintiff is seeking damages for mental anguish, emotional distress, lost wages, front pay, punitive damages, attorney's fees and interest.
Rodriguez is represented by Barrett W. Stetson and Thomas P. Moynihan of the Law Firm of Barrett W. Stetson in Dallas. A jury trial is requested.
