Rubb Inc. added to list of defendants, files answer in trip & fall

Rubb Inc. has responded to litigation brought by Wilford Thibodeaux, who claims he fell while at the Motiva Enterprises refinery in Port Arthur.

As previously reported, Thibodeaux filed suit against Motiva, Jacobs Engineering Group, Bechtel Corp. and Bacon Construction on Jan. 21 in Jefferson County District Court.

Court records show that on July 27 Thibodeaux amended his petition for the third time, adding Rubb as a defendant.

Rubb filed an answer to the petition on Sept. 6, denying all of Thibodeaux's allegations and demanding strict proof.

According to Internet search results, Rubb Inc. is the maker of prefabricated, portable structures, aircraft hangars, buildings, shelters and custom structures for many applications.

Thibodeaux was injured on Jan. 6, 2010. He claims he was an invitee at the defendants' premises at 2555 Savannah Ave. when he fell "due to a dangerous condition," the suit states.

In his suit, Thibodeaux alleges the defendants negligently failed to inspect the premises for dangerous conditions and warn him of the danger.

He is suing for his alleged past and future medical expenses, mental anguish, pain, impairment, disfigurement and lost wages.

League City attorney Kelly Forester represents him.

Rubb is represented by Houston attorney Jeffry O'Dea.

Judge Bob Wortham, 58th District Court, is assigned to the case.
