Brand Scaffold Builders sued over discrimination, sexual harassment

A Jefferson County man is suing over claims he was discriminated against based on his race and sexually harassed at work.

Kamaal Leday filed a lawsuit March 10 in the Beaumont Division of the Eastern District of Texas  against Brand Energy Solutions LLC, Brand Energy Inc., also known as Brand Energy & Infrastructure Services Inc., and Brand Scaffold Builders LLC, citing constructive discharge.

According to the complaint, in September 2010, Leday was employed by Brand as a lead man, then laid off and rehired in February 2011, with reduced pay, even after a promotion. During this time, Leday claims he was paid less than employees of other races in the same, and lower, positions and endured sexual harassment until he complained on Jan. 25, 2012, and was ostracized in the workplace until he had no choice but to quit in April 2012.

Leday is seeking damages and reinstatement.

He is being represented in the case by attorneys Margaret A. Harris and Thomas A. Peterson.
