Driver seeks damages for alleged injuries in FM 14 accident

TYLER – A victim of a traffic accident is seeking damages for the injuries he allegedly suffered.

Jesus Rodriguez filed a lawsuit on Feb. 1 in the Tyler Division of the Eastern District of Texas against Smartway Express Inc. and Betty Martinez over claims of negligence.

Rodriguez alleges that he was driving his 1998 Dodge Ram 3500, towing a trailer down southbound FM 14 on Sept. 30, 2015, when defendant Martinez, an employee of Smartway and operating a 2015 Volvo conventional tractor-trailer, failed to yield the right of way when she prepared to enter FM 14 from a private driveway and collided into Rodriguez.

The front of Rodriguez’s truck was allegedly wedged underneath the trailer, breaking the trailer’s axels and disabling it. Martinez allegedly received a ticket for failure to yield right of way.

As a result, Rodriguez asserts that he has sustained severe injuries, medical expenses, mental anguish, and he claims his treatment will be ongoing.

He is suing for damages, pre- and post-judgment interests, special damages, court costs, attorney fees and any other relief deemed just by the court. He is demanding a jury trial and is represented by Marisa Schouten of Martin Walker PC in Tyler.
