SHERMAN – A Collin County woman is suing a Carrollton debt collection agency, alleging illegal debt collection practices.

Shifra Kaufman filed a lawsuit Dec. 21, in the Sherman Division of the Eastern District of Texas against Scott, Parnell & Associates PC, alleging a violation of the Fair Debt Collections Practices Act.

According to the complaint, on Jan. 9, 2015, Kaufman received a letter from Scott, Parnell & Associates seeking collection of an alleged debt. The suit says the letter misleads the consumer as to her rights, and can cause the consumer to unknowingly waive the protection granted by the law, which requires a written dispute.

Kaufman seeks actual and statutory damages, attorney fees and costs as well as the defendant admitting to violating the Fair Debt Collections Practices Act.  She is represented by attorney Andrew Margolies of the Margolies Law Office in Dallas.
