Shift manager alleges burger restaurant failed to pay overtime

HOUSTON — A Houston woman is suing a chain of hamburger restaurants, alleging failure to pay overtime wages.

Tracy Khan filed a lawsuit July 12 in the Houston Division of the Southern District of Texas against Houston Burger Restaurants LLC, alleging violating the Fair Labor Standards Act.

According to the complaint, since December 2015, Khan routinely worked more than 40 hours per week as a shift manager at the Houston Burger restaurant, 4919 N. Sam Houston Parkway W., Houston, but was paid only her regular hourly wage for all hours worked. The plaintiff alleges failed to pay her extra hours at a rate of one and one-half times her hourly rate of pay for all time spent in excess of 40 hours per week as required by FLSA.

Khan seeks a trial by jury, all unpaid overtime wages, attorney fees and legal costs, plus such other relief as is just and proper. She is represented by attorney Jenny DeFrancisco of Lemberg Law LLC in Wilton, Connecticut.
