Tenant seeks damages from Texas Excel Property Management Services over allegations nail caused fall

HOUSTON – A woman is seeking more than $200,000 from the owners of her apartment complex over claims a nail caused her to fall.

Elizabeth Dominguez filed a complaint on June 21 in the Harris County District Court against Texas Excel Property Management Services Corp. alleging negligence.

According to the complaint, the plaintiff alleges that on May 13, she was injured at defendant's Palm Beach Apartment complex when she tripped over a nail that was not properly hammered down on a walkway and fell. She alleges she sustained injuries resulting in pain and suffering, mental anguish, disfigurement and medical expenses. 

The plaintiff holds Texas Excel Property Management Services Corp. responsible because the defendant allegedly failed to maintain the premises and failed to correct the condition.

The plaintiff requests a trial by jury and seeks monetary relief of more than $200,000 but less than $1 million and such other and further relief that are appropriate. She is represented by John Arthur Daspit and Samy Diab of Daspit Law Firm in Houston.
