Frederick Nicholas sued Inhance Technologies LLC For Wrongful Termination

According to the Texas Court of Appeals, Fredrick Nicholas was terminated from his job at  Inhance Technologies, LLC., formally known as Fluoroseal-International, LLC without due process.

The court case, No. 2015-67125, seen by Justice Sarah Beth Landau confirmed in the appeal case NO. 01-18-00750-CV that Mr. Nicholas was indeed wrongfully terminated.

According to the official court documents, in 2013, Fluoroseal-International, LLC (“FSI”) granted Nicholas a job as the company's health, safety, and environmental director. FSI was Inhance’s antecedent in interest, and later that year, FSI became Inhance Technologies, LLC.

Nicholas accepted the position by signing and dating the mailed letter. The proposal letter provided to the court includes a conflict resolution procurement, requiring the two parties to resolve any disputes related to “employment or termination of employment” in compromise.

According to the documents provided by Inhance Technologies,  Nicholas' job description included dealing with matters related to "environmental permitting and compliance." Mr. Nicholas told the court that his termination was due to his "complying with environmental laws." In other words, he claims to have been terminated for following federal law.  

After being terminated in 2015, Nicholas sued the Inhance company for wrongfully terminating his employment under Sabine Pilot. However, Inhance filed a counter motion as per the agreement in the job proposal letter signed by Mr. Fredrick. The motion was filed to compel arbitration and to postpone the lawsuit pending adjustment.

Even though Mr. Nicholas did not reply to the motion, he agreed to appear at the hearing on it. At the hearing, the court gave Mr. Nicholas additional time to respond to the motion filed by the Inhance company. Yet, Mr. Nicholas still refused to reply to the motion.

According to the court records, Inhance’s motion was granted by the trial court to compel arbitration and sent the case to the American Arbitration Association.” In response to the move, Mr. Nicholas filed three counter motions The court set a hearing for the motions.

The court records show that the judge denied all three of Mr. Nicholas’s motions. Inhance then filed a motion for dismissal. Inhance filed the motion because of Mr. Nicholas's refusal to initiate compromise as per the agreement in the job proposal letter.

Mr. Nicholas then appealed to the Texas appeals court following his three motions being denied.

The appeals court in Texas concurred that Mr. Nicholas was indeed denied due process and that he was wrongfully terminated by Inhance.
