Woman claims Memorial Hermann surgeon failed to remove surgical clip after her procedure

HOUSTON — A woman is claiming Memorial Hermann and its staff provider her with negligent care including failing to remove a surgical clip after her urological procedure. 

Daisy Smith filed a complaint Feb. 21 in the Harris County District Court against Andrew Selzman, M.D., Memorial Hermann Hospital System doing business as Memorial Hermann Memorial City Hospital and others alleging negligence and vicarious liability.

Smith, who was a minor at the time, underwent surgery performed by Selzman for an obstructed kidney and other urologic issues on Nov. 15, 2016 at Memorial Hermann Memorial City. She alleges that in the months following her surgery she suffered complications due to a surgical clip that Selzman had failed to remove during her surgery. She also claims that from November 2016 through April 2019 when the clip was finally discovered, Memorial Hermann failed to provide her an applicable standard of care. 

Smith seeks monetary relief, trial by jury, interest and all other just relief. She is represented by Charles "Scott" Nichols of Clark Hill PLC in Houston.
