Former security guard claims retaliation for taking FMLA to care for son with brain tumor

HOUSTON — A former security guard claims she was demoted for taking FMLA to take care of her son who had a brain tumor. 

Krystal Miller filed a complaint Feb. 28 in the U.S. District Court for the Southern District of Texas Houston Division against Lofton Security Service Inc., alleging violation of the Americans with Disabilities Act and Title VII.

Miller began working for Lofton as a supervisor and lieutenant in December of 2016. Miller took FMLA leave from December of 2016 until February of 2018 after her son suffered a seizure and was diagnosed with a brain tumor. She alleges that after returning from FMLA leave, she was demoted and claims her male supervisor stated she was being demoted because a "women's priorities are childbearing and caregiving." She also alleges she suffered discrimination after suffering a back injury that left her disabled. Miller received a right to sue from the U.S. Equal Employment Opportunity Commission on Aug. 2, 2019. 

Miller seeks monetary relief in excess of $75,000, trial by jury, interest and all other just relief. She is represented by Andrew Golub and Connor Throckmorton of Dow Golub Remels & Gilbreath PLLC in Houston.
