Woman trips over stack of wood while backing away, sues Lowe’s two years later

HOUSTON – As Maria Acosta “backed away” while returning some merchandise at Lowe’s two years ago, she tripped and fell over some stacked wood.

On May 22, Acosta filed suit against Lowe’s Companies, alleging the store failed to warn her of the “unsafe condition of the flooring area.”

According to the lawsuit, on May 25, 2018, Acosta entered a Lake Jackson Lowe’s to return some merchandise. The store allegedly did not have a “clear path” and as a result as Acosta “backed away she tripped and fell violently over a stack of wood.”

In addition to failing to warn her, Acosta alleges Lowe’s negligently failed to inspect and maintain the flooring area.

She maintains the store acted with a “conscious indifference” to her safety and is suing for exemplary damages.

She also seeks damages for her mental anguish, pain, impairment, medical expenses and lost earnings.
