Union Pacific Railroad sued four years after locomotive foreman falls while walking around in the dark

HOUSTON – A Texas man is seeking more than $1 million in damages from Union Pacific Railroad after he tripped and fell while waking around in the dark four years ago.

Jeffrey Powers filed his suit June 2 in Harris County District Court, alleging UPR failed to provide proper lightning conditions.

According to his lawsuit, on July 15, 2016, Powers was working as a locomotive foreman and UPR’s Fort Worth facility. He entered locomotive that had been powered down to conserve fuel.

As Powers descended the locomotive’s steps in the dark, debris on the floor caused him to trip and fall headfirst out of the engine.

In his suit, Powers claims his supervisors told him there was no need to file an injury report because UPR has great insurance and that he would be taken care of.

When he finally went to fill out a claim three years later, Powers learned the statute of limitations had run out.
