Forklift operator claims negligence after truck allegedly backed into him at job site

HOUSTON — A forklift operator is claiming negligence after a truck backed into him while he was working at a Reeves County job site owned by Apache Corporation. 

Camilo Pena filed a complaint July 1 in Harris County District Court, alleging negligence against Apache Corporation and STI Trucking LLC, also known as Stone Trucking International and Stone Trucking Co., doing business as Action Specialized. 

Pena was working as a forklift operator on a well-site owned by Apache in Reeves County on Oct. 19, 2018. He alleges in his complaint that while unloading parts from trucks, he was asked to use his forklift to help one of the truck drivers who was having an issue with the slide out on his truck. 

Pena claims that after returning to his "normal duties," the truck backed into his forklift "with such force." Pena alleges he suffered several herniated disks, debilitating headaches, numbness and tingling that radiates into his shoulder and arm. 

Pena claims in his suit that the driver, who was an agent of Stone Trucking, was not paying attention and failed to control his speed and vehicle, which caused the alleged accident. Pena seeks monetary relief of more than $1 million, interest and all other just relief. He is represented by Ethan Shaw and John Cowart of Shaw Cowart LLP in Austin and J.R.
