Woman alleges defective scooter, Skechers shoes caused her to fall at Memorial City Mall

HOUSTON — A woman is alleging Memorial City Mall's defective scooter as well as the defective design of her Skechers shoes contributed to her fall and injuries. 

Janet Binch filed a complaint July 24 in Harris County District Court against Memorial City Mall LP and Skechers USA Inc., alleging negligence.

Binch alleges in her complaint that on Oct. 1, 2018, she fell at the Memorial City Mall in Harris County and suffered "serious, permanent and disabling bodily injuries." 

Binch claims that her alleged fall was the result of a scooter that was "dangerous to use" and the result of a "defective  and negligent design" of her Skechers shoes. She alleges Memorial City Mall should have taken the dangerous scooter out of use because it was a hazard and that the mall had "knowledge of the potential harm" in allowing the scooter to be used. 

She alleges the mall failed to "perform and inspection" regarding the scooter's safety. Binch also claims her Skechers were "defective and unreasonably dangerous in their design," which contributed to her fall. 

Binch alleges she has suffered "mental and physical pain" disfigurement and loss of wages due to the alleged accident. She also claims she has incurred medical and hospital services as a result of her injuries. 

Binch seeks monetary relief, trial by jury, interest and all other just relief. She is represented by Jeffrey Todd of The Todd Law Group PLLC in Houston.
