Man claims Murphy Oil's negligence after slipping on spill, landing on his car

HOUSTON — A man is claiming the negligence of Murphy Oil after slipping on a oil/gas spill, landing onto his car and suffering injuries.  

Thomas Guidry filed a complaint filed a complaint Aug. 16 in Harris County District Court against Murphy Oil USA, Inc., alleging premises liability and negligence. 

According to the complaint, Guidry was on Murphy Oil's premises on May 27, 2020. He alleges that while getting out of his vehicle, he slipped on "wet oil/gas" and "forcefully" fell onto his car. 

Guidry claims he suffered "severe and extensive" injuries. As a result of his alleged injuries, Guidry, who was 45 years old at the time, claims he suffered "mental and physical pain" as well as impairment, disfigurement and lost wages and incurred hospital, drug and other medical expenses as a result of his injuries. Guidry alleges in his suit that customers had notified Murphy of the spill but they failed to remedy the "dangerous condition." 

He also alleges the oil/gas spill "posed an unreasonable risk of harm because individuals walking through the parking lot" could slip and fall. Guidry claims Murphy failed to warn customers of the condition and breached their duty of care by not making sure their property was in a "reasonably safe" condition. 

Guidry seeks monetary relief, interest and all other just relief. He is represented by Jeffrey Todd of The Todd Law Group PLLC in Houston.
