Houston-based waste company faces suit alleging they failed to pay driver for overtime

HOUSTON — Houston-based Waste Connections is facing a suit by one of its former drivers claiming he was not paid for overtime work.  

Jerry Hotz filed a complaint Sept. 3 in the Houston Division of the Southern District of Texas against Waste Connections Lone Star Inc., Waste Connections US Inc., and Waste Connections US Holdings Inc., alleging violation of the Fair Labor Standards Act (FLSA).  

According to his complaint, Hotz worked as a waste disposal driver for Waste Connections and hauled waste and garbage to various sites. He alleges that he "routinely" worked more than 40 hours per week without receiving overtime pay and that he often worked through his 30 minute meal period breaks "off the clock" because they were deducted from his pay. 

Hotz claims he was not an exempt employee under the FLSA and according to Texas law and that Waste Connections "knowingly and deliberately" did not pay him for all the hours he worked through a "compensation scheme." He also claims Waste Connections "knew or should have known" about the miscalculations to his pay which caused him "financial injury."
