GALVESTON — Fertitta Hospitality has filed suit against the Galveston Central Appraisal District claiming its Hilton Hotel and San Luis Hotel have been appraised unlawfully.
Fertitta Hospitality Inc., filed a complaint Sept. 18 in Galveston County District Court against the Galveston Central Appraisal District alleging violation of the Texas Property Tax Code.
Fertitta Hospitality alleges in their complaint that two of their Galveston properties, the Hilton Hotel and the San Luis Hotel located on Seawall Boulevard, have been appraised by the Galveston Central Appraisal District in excess of the properties market values. Fertitta claims the apprised value of the properties is unlawful and is seeking an appeal to reduce the appraised value as of January 1 made by the Galveston Central Appraisal District.
They further alleged the properties were appraised "unequally" and that the "unlawful appraised value" of the properties will cause a tax on the properties to also be unlawful. "The Texas Property Tax Code and Constitution require property to be appraised in an equal and uniform manner," the plaintiffs state in their complaint.
Fertitta seeks monetary relief between $100,000 and $200,000 and all other just relief. They are represented by Mark Hutcheson and Daniel Smith of Popp Hutcheson PLLC in Austin.
