HOUSTON – A legal malpractice suit has been brought against Harris County Clerk Chris Hollins and his law firm.

As previously reported, Hollins was hit with a lawsuit in August alleging a firm employee unlawfully solicited a man who had just been in an automobile accident.

On Nov. 9, Hollins and the Hollins Law Group were hit with another lawsuit accusing the firm of signing up a woman who had just been in an auto accident then allowing the statute of limitations to expire on her case.

According to the petition, Mary Reissinger alleges that on May 19, 2018 she was involved in an automobile collision. A tow truck driver referred her to the Hollins Group.

“When they arrived at the tow yard, the driver took Resssinger straight into his office and handed her the phone which was already calling Hollins’ law group,” the suit states. “Defendant’s company also convinced plaintiff to sign a contract with their law group over the phone and allow them to represent her in her bodily injury claim.”

Hollins’ firm then sent Ressinger to several doctors and specialists, causing her to accumulate a large amount of charges that the law firm said would be paid for when the case settled.

Two years later, Ressinger asked if the law firm had reached a settlement yet and received the following response: “You have a four year statute of limitations on your case so don’t worry about it.”

The statute of limitations is two years.

To this day, the medical providers have not received any payment for Ressinger’s care.

“Both Defendants failed to pay attention to her case and allowed her two year statute of limitations to run out without having done much, if anything to either file the lawsuit or reaching a settlement agreement with the at-fault insurance carrier,” the suit states.

“Plaintiff has incurred … medical expenses and now cannot repay the providers … due to the negligence of Hollins.”

Ressinger is seeking up to $1 million in damages.

Montgomery attorney Kevin Forsberg represents her.

Filed in Harris County District Court, case No. 2020-71934
