Justices affirm dismissal of slip & fall against Houston Methodist

HOUSTON – The First Court of Appeals has affirmed the dismissal of a slip and fall lawsuit against Houston Methodist Hospital.

The lawsuit was brought by Mary Lou Lujan, who claims she slipped in a puddle of water while visiting her brother who just underwent heart surgery at the hospital.

Court records show a trial court rendered summary judgment in favor of Houston Methodist, prompting the appeal.

On Dec. 29, the First Court affirmed the judgment, concluding Lujan has not raised a genuine issue of material fact that Houston Methodist was actually aware of the liquid on the floor that caused her to slip and fall.

“Thus, we hold that the trial court did not err in granting Houston Methodist summary judgment,” the opinion states.
