Houston couple alleges plumber's negligence led to water, mold damage

HOUSTON — A Houston couple claims their home suffered major water and mold damage due to the negligence of a plumbing and excavating company. 

Carlton Palmer and Brenda Oliver Bagley filed a complaint  March 8 in Harris County District Court against American Residential Services, ARS Intermediate Holdings LLC, Michael Palomo doing business as Palomo Services and Michael Palomo alleging breach of contract, breach of implied warranty of good and workmanlike manner, breach of implied warranty, violation of the Deceptive Trade Practices Act and negligence. 

According to the plaintiffs' complaint, Carlton Palmer requested the plumbing services of ARS Rescue Rooter on March 9, 2019, after water overflowed from a toilet and had entered into the hallway and bedrooms of their home located on Ridgehaven Drive in Houston. They allege that an  ARS' employee told them there was a sewer line break and gave them a $7,466 estimate to repair the main sewer lines. 

The plaintiffs further allege that the ARS' employee scheduled an excavation company who excavated15 feet underneath their home and replaced the pipes without their permission. They claim the ARS' employee failed to pump the remaining water out of their home, failed to inform them about the danger of not drying out the areas and failed to perform any tests on their plumbing system. The plaintiffs allege that their home had additional water damage as well as mold damage due to the defendants' negligence.

The plaintiffs seek monetary relief between $200,000 and $1 million, interest and all other just relief. They are represented by Attorney Terence Anderson of Terence J. Anderson in Houston.
