Man sues flooring contractor over defective installation job

HOUSTON — A man claims a Houston area flooring contractor refuses to make good on a defective wood flooring installation job.   

Hedley Karpas filed a complaint July 13 in Harris County District Court against Swiff-Train Company LLC doing business as Earthwerks alleging breach of contract and negligence. 

Karpas alleges that the defendant provided "engineered" wood floors for his residences in Houston and that after installation, he noticed defects in the flooring. Specifically, the finish adhesion applied to the floors had caused them to peel from the "underlay or concrete subfloor" and the stain on the planks began to flake. Karpas claims the defects, which were confirmed by a hired inspector, "Progressively deteriorated the overall condition of the floors." 

He further claims the defendant has failed to respond to his demand for a replacement or to pay for replacement by another contractor. Karpas alleges the defendant failed to "exercise ordinary and reasonable care in providing the floors" free of defects in breach of their contract. 

Karpas seeks monetary relief of $250,000 or less and all other just relief. He is represented by Carlton Wilde, Jr., and John Wooldridge, Jr., of Crady Jewett McCulley & Houren LLP in Houston.
